The Demise of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency sparked by the announcement of a new comprehensive peace framework for resolving the conflict appeared – briefly – to have been stabilised. A American diplomat spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its retaliation: a renewed assault of rocket attacks on Kyiv.

The Rhythm of Peace Talks and Military Action

The chain of opposing developments captured the grim essence of the recent timeframe. By day, negotiation efforts are waged: optimistic declarations are released from different nations. Considerable effort is expended on restraining specific proposals. By night, Russian leadership brutally reminds the world that, for them, military action persists as the key method for achieving "settlement".

After-Dark Attacks

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was revealed. Ukraine is capable of detecting projectile deployments from Russian territory, a capability enabled by up-to-date information. From observation points, military aircraft that had been scrambled to counter approaching cruise missiles streaked across the sky – advanced fighter aircraft supplied to Ukraine by Western partners.

Shortly after, Kyiv's air-defence systems engaged: several firings deployed against a Russian ballistic missile. This was a sophisticated defense system at work, presumably delivered by Western nations. Every firing shakes the surroundings, rattling buildings. The brief panic quickly transforms into grim resignation: possibly the incoming missile won't hit its mark this time, protecting urban areas from devastation and further power outages.

Continuous Dangers

Following this, a automatic firearm engaged a unmanned aircraft somewhere nearby, part of a rapid response unit – almost certainly imported technology. Unfortunately, the projectiles didn't strike the opposing UAV – it pressed on overhead toward its target.

With pauses, this continued until dawn. Kyiv awoke to the morning news: multiple fatalities, damage and utility failures in numerous residences as a result of the nocturnal offensive. As typically, everyone still maintained normal activities – experiencing conflict. But those 24 hours encapsulated Ukraine's critical military reliance on international aid – a need that neighboring countries are demonstrably unable to replace in the near term.

Unsuccessful Negotiations

The detailed framework from US administration generated strong feelings, controversy and serious worry – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and international summits.

Every new initiative from American administration adheres to the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They stabilise the situation but never actually achieve victory. This cycle will, undoubtedly, endure.

Tactical Assessments

It is tempting to accuse certain parties of repeatedly advocating Russian terms. But that does not seem to be the complete picture. Washington functions according to a premise well known to experienced diplomats: you cannot win at the negotiating table what you have been unable to protect through force. The American government believes that it is unfeasible to pressure the Kremlin to surrender the land that it already controls in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, American administration does little to discourage Russia, through statements or actions, from assuming that the status quo will not evolve additionally in its benefit in the near future.

Conflicting Perspectives

Therefore, the Kremlin is convinced that the clock favors them – that Ukraine and its supporters are coming close to fatigue. Their motivation to accept conditions that does not give them the maximum possible gain is virtually nonexistent. There may be multiple initiatives to stop fighting, but they will persist as long as Russia's leader remains highly assured in the result.

On the contrary, Kyiv believes that Ukraine can still endure, slowly losing lives and land but averting a complete military breakdown until conditions improve in its benefit.

Existing Situation

Factually, there are no actual prerequisites for a truce. Now, personal considerations are entering the equation: personal goals to negotiate peace and obtain worldwide acknowledgment, and the government's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the country's interests against any plan Kyiv finds unsuitable, so that their focus does not shift toward internal issues. And although their task will now be significantly challenging after current events, it remains quite doubtful that this will change their overall approach.

These conflicting dynamics are driving the talks.

Summary and Prospects

It took a just a single week to terminate the proposed articles of the current initiative. Assertive and inconsistent approach of the matter by Washington, pushback by Ukraine and the rest of Europe, along with soothing efforts of negotiators, and finally, current information leaks, all served their function.

While new plans based on established approaches are approaching, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to counter political attacks from Washington that are founded on Moscow's terms and demonstrate certain reluctance to change the course of events, if they remain united and strengthen their defence capabilities at a much faster pace. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the coming months, primarily depend on continued Western support.
